General terms and conditions of sale

The present general conditions of sale apply, without restriction or reserve to all services and benefits offered by the company Taghazout Golden Spa, on its website and for customers (“Customers”) or visitors.

ARTICLE 1 – Scope and purpose of online services

Otherwise, the use of online booking services is prohibited.

Through its website, the company Taghazout Golden Spa offers the Customer the possibility to access a complete range of beauty and aesthetic treatments, to be booked online in its establishment.

Consequently, the fact for a natural or legal person to make a reservation or purchase (“order” or “order”) on the website of the company Taghazout Golden Spa implies full acceptance of these general conditions of sale.

They are accessible at any time on this website and will prevail, where applicable, over any other version, it being specified that only the version in force at the time of the Customer’s order will be enforceable against him.

ARTICLE 2 – Terms and conditions and choice of orders on the website

1) Registration on the Site

In order to place an order on the Site, the Customer must enter his or her surname, first name, email address, telephone number and possibly any other element that allows the Customer to personalize his or her experience, such as his or her date of birth, for example.

In case the information provided by the Customer is false, incomplete or obsolete, Taghazout Golden Spa reserves the right, without any compensation and without notice, to suspend or terminate the Customer’s account, to delete all or part of the Customer’s data, without prejudice to the actions of common law that may be open to him.

2) Ordering

The reservation of certain services may give rise to a request for online payment. 3) Modification, cancellation and withdrawal

The Customer can modify his reservation up to 24 hours before the initial reservation date by contacting Taghazout Golden Spa directly.

In application of the law in force, when the Customer wishes to cancel a reservation, he can retract within the legal period of 3 days from the date of his order, provided that he has not begun to receive the service ordered during this period.

ARTICLE 3 – Payment

The provision of services is carried out against payment by the Customer of the total price corresponding to the chosen service, according to the modalities established in the Establishment Taghazout Golden Spa.

The price is payable, according to the offer (in full) and in one instalment with the order and is valid as confirmation of the order.

The prices indicated on the website are based on Moroccan Dirhams and include all taxes, convertible according to the customer’s currency so the exchange rates correspond to those in force on the day of the order.

The company Taghazout Golden Spase reserves the right to change prices at any time, the price indicated in the order confirmation being the current price.

The payment will only be considered final after the actual receipt of the funds by Taghazout Golden Spa.

The payment of purchases is made by credit cards, the accepted cards being the following: CB, VISA, MASTERCARD. Securing payments by PAYPAL according to its own conditions.

At no time Taghazout Golden Spa is recipient or has access to the bank details that are only collected and possibly stored by the payment provider.

ARTICLE 4 – Provision of services

The services ordered by the Customer will be provided upon presentation of the order confirmation received by email, in the establishment Taghazout Golden Spa.

In case of impossibility for the establishment Taghazout Golden Spade to provide the service ordered during the period of validity of the voucher, the establishment Taghazout Golden Spa undertakes to reimburse the price of the voucher or a credit of the same amount within a maximum period of 10 days, by crediting the credit card charged to the order, excluding any compensation or deduction.

ARTICLE 5 – Liability of the Provider

Taghazout Golden Spa is fully responsible towards the Customer for the proper execution of the contract concluded with the Customer.

However, Taghazout Golden Spa cannot be held liable for the non-performance or improper performance of the contract concluded in case of force majeure, the occurrence of a fact attributable to the Customer or any inconvenience, unforeseeable and insurmountable damage inherent to the use of the Internet network, including a break in service, external intrusion or the presence of computer viruses.

The reservation services offered on the website of Taghazout Golden Spa are provided by the BOKUN platform (operator of Tripadvisor) which acts as a service provider on behalf of the company Taghazout Golden Spa.

Acceptance of these Conditions implies the recognition that the company BOKUN acts solely as an agent without any liability for any of the obligations of Taghazout Golden Spa in the performance of the services ordered.

As such, once any reservation on the Site has been made and the desired service is available, the contract will be concluded between the Customer and the Establishment Taghazout Golden Spa.

Unless otherwise provided by law, the company BOKUN shall in no case be liable in case of failure of the company Taghazout Golden Spa to meet its obligations arising from the services sold through it.

The company Taghazout Golden Spa will not be considered as responsible or defaulting for any delay or non-performance due to the occurrence of a case of force majeure usually recognized by French jurisprudence.

ARTICLE 6 – Data Processing and Freedom

Pursuant to Law No. 78-17 of January 6, 1978 as amended by Law No. 2018-493 of June 20, 2018 and EU Regulation No. 2016/679 “RGPD”, it is recalled that the personal data requested from the Customer are necessary for processing his order and are intended for internal use.

These personal data may nevertheless be transmitted to third parties, service providers or subject to express consent, partners of the company Taghazout Golden Spa.

By accepting these GCS, the Customer is granted, on a personal basis, the non-exclusive and non-transferable right to use the Site and the Services within the framework and for the duration of your registration to the Services.

ARTICLE 8 – Applicable law

These General Conditions are governed exclusively by Moroccan law and exclusive territorial jurisdiction is given to the Moroccan courts.

The Client expressly acknowledges the probative force of the electronic writing as used on the site and acknowledges that the data recorded by BOKUN are authentic and constitute proof of all past transactions.

Any dispute that may arise from the interpretation or execution of these terms and conditions of sale and its consequences will be subject to the exclusive jurisdiction of the Moroccan commercial courts.
